Terms of Use

These terms govern the use of the Zyroo mobile application and the zyroo.app site (the “Service”), operated by Zyroo (“we”). By creating an account or using the Service you accept these terms. If you do not agree, do not use the Service.

1. What Zyroo is

Zyroo records your vehicle trips using your phone's GPS and estimates the fuel consumed, its cost, CO₂ emissions and a driving score, using a physical model calibrated to the vehicle you register. The results are estimates — see section 6.

2. Your account

Access is through your Google or Apple account. You are responsible for keeping that account secure.
You must provide accurate information (for example, the vehicle you register in your garage — your estimates depend on it).
You must be at least 16 years old to use the Service, and of legal driving age if you record trips as a driver.
You can delete your account at any time from Profile → Account → Delete account.

3. Safety while driving

Do not interact with the App while driving. Zyroo is designed so that you don't have to touch it during the trip: start the trip before setting off and review your report on arrival. You are solely responsible for driving attentively and for complying with applicable traffic laws.

4. Zyroo Premium subscription

Some features require the paid Zyroo Premium subscription, with automatic renewal.
The price and the period are shown in the App before you confirm the purchase. Billing is processed by your store (App Store or Google Play) with your store payment method.
The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the start of the new period.
You can manage or cancel the subscription in your store's subscription settings (App Store or Google Play), also reachable from the App at Profile → Zyroo Premium.
If we offer a free trial period, any unused portion is forfeited when you purchase the subscription.
Refunds are handled by the corresponding store according to its policies.

On Apple devices, use of the App is additionally governed by the standard Apple EULA to the extent it does not contradict these terms.

5. Acceptable use

You agree not to:

Use the Service in a way that violates the law or the rights of third parties.
Attempt to access other users' accounts or data.
Decompile, reverse-engineer or extract the App's code, except where the law expressly permits it.
Overload, interfere with or abuse our servers or APIs, or access them by unauthorized automated means.
Resell or sublicense the Service.

6. Estimates — not a measuring instrument

The consumption, cost, CO₂ and score that Zyroo displays are statistical estimates derived from GPS and a physical model of the vehicle. They do not come from engine sensors and their accuracy depends, among other things, on GPS signal quality, the registered vehicle and the actual trip conditions.

Do not use these figures for tax, accounting, legal, billing or official reimbursement purposes.
They do not constitute mechanical or financial advice.

7. Your data

The processing of your personal data is described in our Privacy Policy. By using the Service you grant us the license necessary to process the data you generate (trips, vehicles, refuelings) for the sole purpose of operating the Service for you.

8. Intellectual property

The App, its design, its calculation model, its trademarks and its content are the property of Zyroo or its licensors. We grant you a personal, limited, non-exclusive and non-transferable license to use the App on your devices. The vehicle catalog data comes from public and third-party sources.

9. Service availability and changes

We may modify, suspend or discontinue features of the Service (including Premium features, giving you reasonable notice if it affects an active subscription). We do not guarantee uninterrupted availability.

10. Disclaimer of warranties and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by law, Zyroo shall not be liable for indirect, incidental or consequential damages arising from the use of the Service — including driving, mechanical or financial decisions made based on its estimates. Our total aggregate liability shall not exceed what you paid for the Service in the 12 months before the event giving rise to it.

11. Termination

You may stop using the Service and delete your account whenever you want. We may suspend or close accounts that breach these terms. Sections 6, 8 and 10 survive termination.

12. Changes to these terms

We may update these terms; if the change is substantial we will note it in the App or on this page by updating the date. Continued use after the change implies acceptance.

13. Governing law

These terms are governed by the laws of the Dominican Republic, without prejudice to the protections granted to you by the mandatory rules of your country of residence.
